Terms of Service

Effective 4 October 2026 · Operated by Cashmint Solution Private Limited

These Terms govern use of MessagePilot (the “Service”), operated by Cashmint Solution Private Limited, a private limited company, G-14, Flat 2206, Nirala Greenshire, Greater Noida West, Uttar Pradesh 201318, India (“MessagePilot”, “we”, “us”). By creating a workspace or using the Service on behalf of a business, you agree to these Terms, the Acceptable Use and Anti-Spam Policy and the Privacy Policy.

1. Who may use the Service

The Service is for registered businesses and other organisations that send transactional email and marketing email their recipients have agreed to, to their own customers, members or users. You must be authorised to bind the business you register, and you are responsible for everyone you invite to your workspace and for anything sent from it. A workspace belongs to the business, not to an individual employee.

2. What the Service does

MessagePilot lets a business keep its contact lists and consent records, write campaigns and automations, and send email and WhatsApp messages to its own recipients. Recipients do not need a MessagePilot account.

Today, email is sent through sending accounts that you connect (for example your own SMTP server, Google Workspace or Microsoft 365 mailbox), and WhatsApp messages are sent through our WhatsApp provider. We are building email sending through infrastructure we operate. It is not available to customers yet. When it is, these Terms will apply to it, and you will need a verified sending domain to use it.

3. Senders, domains and authority

  • You may send only from domains, mailboxes and WhatsApp numbers that you own or are authorised to use for the business named in your workspace, and only on that business’s behalf.
  • The sender name and address must identify that business truthfully. You must not impersonate any other person, business, brand or MessagePilot.
  • You can prove that your business controls a domain by publishing a DNS record we give you. Once a business has verified a domain, no other business on MessagePilot can send from it. Where we ask you to verify a domain, you must not send from it until it is verified, and you must tell us promptly if your authority to use it ends.
  • When you send through your own email provider, your mail always comes from that account’s own address, and your provider authenticates it.
  • We may refuse, limit or remove a sender identity that we reasonably believe you are not entitled to use.

4. Your recipients and their data

You decide whom you contact and why. When you add contacts, MessagePilot asks you to state how they agreed to hear from you and records it, and our sign-up forms record what the person saw and when they submitted it. For recipient data you upload or collect through the Service you are responsible for: having a lawful basis to process it; obtaining and keeping evidence of any consent you rely on (when, how and to what the person agreed); honouring opt-outs and requests from the people concerned; and complying with the laws that apply to you and your recipients, including email and anti-spam, privacy, consumer and telecom rules. For that data, we process it on your instructions to provide the Service, as described in the Privacy Policy.

5. Transactional and marketing messages

Transactional messages are ones a recipient needs because of their own relationship or activity with your business: receipts, order and booking updates, account and security notices, codes they requested, replies to an enquiry they made. They must not contain promotional content beyond what is incidental.

Marketing messages are everything else that promotes your business, products or offers. Marketing requires the recipient’s prior consent to your business. Consent given to another workspace, another brand or a list you obtained elsewhere does not count. Every marketing email must include a working way to unsubscribe, which you must not remove or obstruct, and you must stop marketing to anyone who opts out promptly and in any case within the time the law requires. MessagePilot adds an unsubscribe link and one-click unsubscribe headers to the campaign and automation emails it sends for you. Calling a promotional message “transactional” does not make it one. The Acceptable Use Policy sets out these rules in full.

6. Sending providers you connect

When you connect your own email provider, your messages are sent from your account with that provider, under its terms and limits. You are responsible for that account and its credentials. We store the credentials only to send on your behalf, and you can remove them at any time. Deliverability is decided by the receiving systems and providers, which we do not control.

7. Quotas, plans and payment

Plans include sending allowances shown on the pricing page. Paid plans are billed in advance through our payment processor. Unless the law requires otherwise or we agree in writing, fees already paid are not refundable. We may apply rate limits to protect the Service and recipients, and may change plans or prices with notice before your next billing period.

8. Investigation, suspension and termination

If we receive a complaint, see high bounce or complaint rates, or otherwise have reasonable grounds to believe the Service is being used in breach of these Terms or the Acceptable Use Policy, we may investigate. We may ask you for information, including evidence of consent. While we do so, we may pause sending, campaigns, automations or sender identities. We will tell you what we did and why, unless the law or a risk of further harm prevents it. You can respond and ask us to review a decision by writing to support@cashmint.in. We will reconsider in good faith and tell you the outcome.

We may suspend or terminate a workspace for serious or repeated breaches, unpaid fees, unlawful use, or where continuing would expose recipients, other customers or MessagePilot to harm. You may stop using the Service at any time. Termination does not remove your responsibility for messages already sent.

9. Your content and data

You keep all rights in your content, contact lists and data. You give us permission to host, process and transmit them only as needed to run, secure and support the Service and to meet legal obligations. Deleting data, exporting it, and closing an account are described in the Privacy Policy.

10. Disclaimers and liability

We work to keep the Service available and secure, but provide it “as is”. We do not guarantee that any message will be delivered, reach an inbox or be read. To the extent the law allows, we are not liable for indirect or consequential losses or lost profits. Nothing in these Terms limits liability that cannot be limited by law. You will compensate us for claims by third parties arising from messages you sent or data you supplied in breach of these Terms or the law.

11. Changes, law and contact

We may update these Terms. For changes that materially affect you, we will give notice in the Service or by email before they take effect. These Terms are governed by the laws of India, and the courts of India have jurisdiction, subject to any rights the law of your location gives you. Contact: support@cashmint.in.
